Quotes – Terms and Conditions
Mactec Electrical Pty Ltd
By accepting a quote from Mactec Electrical Pty Ltd (“Mactec”, “we”, “our”, or “us”), you (“the client”) acknowledge and accept the following Terms and Conditions. Acceptance of any quote automatically constitutes full agreement to these terms.
These terms apply in addition to all other Mactec Electrical Terms and Conditions, including our General Service Terms, Invoicing Terms, and Real Estate Client Terms, where applicable.
1. Verbal Quotations and Provisional Sums
- Any verbal quotation, whether given in person or over the phone, is to be treated as a provisional estimate only.
- A formal written quote must be obtained and accepted before any works commence.
2. Quotation Validity and Scope
- All quotes are valid only for the specified time period stated on the document (typically 14 or 30 days).
- If a quote is accepted after the validity period, Mactec reserves the right to:
- Adjust pricing to reflect updated labour or material costs
- Alter or revise the scope of works in line with current site conditions or market availability
- Only parts, services, or work specifically listed and itemised in the quote will be provided. No verbal commitments or assumptions will be honoured unless formally documented.
3. Site and Installation Requirements
To ensure the safe and efficient delivery of services, the following conditions must be met before and during installation:
- The site must be compliant with current electrical regulations, including AS/NZS 3000:2018 and any other applicable Australian Standards.
- The quote does not include any rectification work necessary to bring existing installations up to compliance unless explicitly stated.
- The site must be:
- Free of obstructions, building materials, debris, or interference by other contractors
- Easily accessible to Mactec personnel, vehicles, and equipment
- Safe and structurally sound to allow for uninterrupted work
Any delays, interruptions, or added labour required due to access issues or non-compliant conditions may result in variations to the quoted price.
4. Preexisting Condition Disclaimer
By engaging Mactec Electrical, the client acknowledges and agrees to the following:
a. Age and Condition of Existing Structures
Mactec Electrical is not liable for any damage, defect, or delay caused by the condition or deterioration of existing building elements or materials, including (but not limited to) timber, concrete, insulation, switchboards, wiring, or plumbing.
It is the client’s responsibility to maintain and address any preexisting conditions before commencement of electrical work.
b. Force Majeure
Mactec shall not be held liable for any delay, failure, or additional cost due to circumstances beyond our control, including but not limited to:
- Acts of God or natural disasters
- Unforeseen structural problems
- Adverse weather events
- Civil unrest or supplier delays
c. Indemnification
The client agrees to indemnify and hold harmless Mactec Electrical, its employees, agents, and subcontractors from any liability, loss, claim, or damage arising from:
- The condition of the property
- Preexisting faults or hazards
- The failure of other trades or services
d. Professional Assessment Encouraged
We strongly advise all clients to engage a licensed building inspector or structural engineer prior to engaging Mactec Electrical, particularly for older homes or complex builds, to avoid any future complications or liability disputes.
5. Variations and Adjustments
If any of the above terms or site requirements are not met, or if unforeseen conditions or complications arise after acceptance of the quote, Mactec reserves the right to:
- Modify the quoted amount to reflect the change in scope or complexity
- Charge variation fees for additional materials, labour, or time spent
- Pause work until approval is granted by the client
We will always endeavour to notify you of any variations as soon as they arise.
Deemed Consent for Variations Under 10%
If you are deemed uncontactable and the required variation is less than 10% of the total quoted amount, Mactec Electrical may proceed without formal approval. This allows the work to continue without delay and ensures your project is not held up unnecessarily.
6. Cancellation or Withdrawal After Acceptance
If you choose not to proceed with the revised works after we have notified you of variations, you must inform Mactec immediately in writing.
In such cases:
- The job will be cancelled
- Any labour, materials, or costs incurred up to that point will be invoiced and must be paid immediately
7. Payment Terms
- Standard payment terms are 14 days from the invoice date, unless otherwise agreed in writing.
- Progress payments may be required for larger jobs or staged works, as specified in the quote.
For overdue invoices and payment terms, please refer to our Invoicing & Payment Terms.
8. Confidentiality
All quotes, documents, designs, and communications provided by Mactec Electrical are confidential and must not be shared with third parties without written consent. Any unauthorised disclosure or use of Mactec’s intellectual property will be considered a breach of commercial confidence and subject to legal action.
9. Changes to Terms
Mactec Electrical reserves the right to update or revise these terms and conditions at any time. The most current version will be available on our website.
Acceptance of Terms
By accepting a Mactec Electrical quote—verbally, via email, or in writing—you are deemed to have read, understood, and agreed to all of the above conditions.
